What is the Digital Single Window for Rentals
The Royal Decree 1312/2024, dated December 23, regulating a new procedure for registering short-term rental contracts, came into force. This is a new obligation for landlords to electronically communicate information about temporary contracts and room rentals to the administration through the Digital Single Window for Rentals.
This registry will be mandatory not only for tourist rentals but also for any rental that is not long-term, including situations such as moving for work, studies, or medical treatment, among others.
The obligations apply to both landlords and the platforms that advertise rental services (such as Airbnb or Booking). The following will be required:
• Registration in the Property Registry or the Movable Goods Registry to post an ad on digital platforms.
• Completion of the application and submission of documents.
• Responding to any potential requests from competent authorities regarding rental services.
• Updating any changes in the Property Registry.
• Communicating the registration number to the platforms where the rental is advertised.
This Royal Decree is just the beginning of a new phase of administrative management aimed at eliminating the marginalization of rental contracts, combating abuse, and regulating the proliferation of rentals that used to operate in legal loopholes with inflated prices. Unfortunately, as the popular saying goes, “the innocent will pay for the guilty,” but if managed correctly, there is no cause for alarm; those who rent out a room to help cover regular expenses and do not view this income as a professional activity will see their impact proportional to the income received.
